133.12 TABLE OF ORGANIZATION.
   (a)   The following grades and maximum numbers of positions are hereby established for the paid Police Department of the City of Wheeling in accord with Chapter 8, Article 14 of the W.Va. Code:
 
      Chief       1
      Deputy Chiefs    2
      Lieutenants    4
      Sergeants    15
      Corporals    15
      Police Officer II 20
      Police Officer I    Indefinite
 
   (b)   In the event of a vacancy in the grade of Lieutenant, Sergeant, Corporal, or Police Officer II, and if a valid eligibility list is in force, the City Manager shall, within thirty days from the date on which the vacancy occurs, request that the Police Civil Service Commission certify the eligibility of an officer for promotion pursuant to the procedures set forth in Article 14, Chapter 8, of the W.Va. Code and the Rules and Regulations of the Police Civil Service Commission of the City of Wheeling. If no such eligibility list is in force, the Police Civil Service Commission shall establish one within a reasonable time.
      (1)   Reduction in the Sergeants classification will be achieved through specific attrition; meaning that Sergeants positions who currently do not supervise personnel will not be back filled. The position of Sergeant to be backfilled is within the Chief's discretion based upon if the position being vacated which is currently held by a Sergeant's rank is a position that does not have staff supervisory roles. This reduction process in the Sergeant's rank shall be effective upon passage of the Ordinance. The reduction of five (5) in the Sergeants position shall also have an effect of increasing by five (5) the Police Officer II position by attrition.
      (2)   Any future reduction in number of the members of the paid Police Department shall be achieved by decreasing the number of positions in the grade of Police Officer I. As such, there shall not be a stated number of positions in the grade of Police Officer I.
      (3)   Each officer of the Police Department of the City of Wheeling shall faithfully perform the duties assigned to him by the Chief of Police, regardless of rank.
