800.03 LIENS GENERALLY.
   Except as otherwise provided, "lien" or "liens" as used in this section shall arise whenever the charges corresponding with the services, as defined in this section, are levied or imposed by the City of Wheeling and such charges become due. Liens placed for fee collection have a secured priority lien interest when any subject property is sold, even in federal state or county tax commission sales. Therefore, liens placed pursuant to this section shall not be dissolved during or due to such tax sale and shall remain in effect so that any subsequent owner of the property takes the property subject to all municipal liens. Liens that remain unsatisfied by payment in full to the municipality may be subject to sale by the municipality to satisfy the lien. Any filing fees that a municipality must pay to a court of competent jurisdiction to seek enforcement shall be waived to effect such filing yet shall be collected as part of the debt owed by the property owner and payable directly to the court wherein the action is filed so long as the claim only involves the collection of fees and interest due to such municipality excluding attorney fees. Such evidence of fees being paid is required prior to any release of the lien by the municipality.
