(a) All bonfire or rubbish fires shall be regulated by the provisions of this section. No person shall kindle or maintain any bonfire or rubbish fire or authorize any such fire to be kindled or maintained, on or in any public street, alley, road or other public ground without a permit. Where kindling or maintaining a bonfire or rubbish fire is prohibited by State statute or local ordinance, no permit shall be issued.
(b) No person shall kindle or maintain any bonfire or rubbish fire or authorize any such fire to be kindled or maintained on any private land unless:
(1) The location is not less than fifty feet from any structure and adequate provision is made to prevent fire from spreading to within fifty feet of any structure; or
(2) The fire is contained in an approved waste burner with closed top, located safely not less than fifteen feet from any structure.
(c) The Chief of the Fire Department may prohibit any or all bonfires and outdoor rubbish fires when atmospheric conditions or local circumstances make such fires hazardous.
(d) No person shall kindle or light an outdoor fire in Fire Zone No. 1 as set forth on the Fire Zone Map No. 1 approved by Council, January 15, 1946.
