(a) The Chief of the Fire Department shall have authority as may be necessary in the interest of public safety, health and general welfare to promulgate rules and regulations, to interpret and implement the provisions of the Fire Prevention Code, to secure the intent thereof and to designate requirements applicable because of climatic or other conditions, but no such rules shall have the effect of waiving any fire safety requirements specifically provided in the Fire Prevention Code, or violating accepted engineering practice involving public safety.
(b) The Chief of the Fire Department with the approval of Council shall have the power to modify any of the provisions of the Fire Prevention Code upon application in writing by the owner or lessee, or his duly authorized agent when there are practical difficulties in the way of carrying out the strict letter of this Code, provided that the spirit of this Code shall be observed, public safety secured and substantial justice done. The particulars of such modification and the decision of the Chief of the Fire Department thereon, shall be submitted to Council for its approval, and when approved by Council shall be entered upon the records of the Department, and a signed copy shall be furnished the applicant.
