925.01 DEFINITIONS.
   The following words, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
   (a)   "Garbage" means all refuse or accumulation of animal, fish, fowl, fruit or vegetable matter that attends the preparation, use, cooking, retail or wholesale dealing in, or storing of, meat, fish, fowl, fruit or vegetables, and all foodstuffs condemned as unfit for use by the proper authorities, and includes garbage wrapped in paper, or its equivalent.
   (b)   "Person" includes any individual, firm, partnership, association, corporation or entity.
   (c)   "Rubbish" means all discarded paper (except newspaper), cardboard, lawn and grass trimmings, and similar ordinary household trash, in containers, and trees and parts of trees, except trunks, if cut in four-foot lengths or less, and tied securely in bundles.
   (d)   "Recyclable material" means a material which would otherwise become municipal, industrial or commercial solid waste, which can be source separated, collected, processed and returned to the economic mainstream in the form of raw materials or products.
   (e)   "Recycling" means any process where waste materials are collected, manufactured into new material and used or sold again in the form of new products or raw materials.
   (f)   "Source separate" means the removal of recyclable materials, at the point of solid waste generation, from that waste which is to be landfilled.
   (g)   "Commingled" means those source separated, nonputrescible, recyclable materials that are aggregated into a container(s) to facilitate collection and transportation to a facility for further processing.
   (h)   "Designated recyclable materials" means those recyclable materials specified in the "Wheeling Recycling Feasibility Study and Recycling Plan" for separation and collection and in accordance with this article. Such materials may include, but are not limited to: aluminum, steel and bi-metal food and beverage cans; clear glass containers; and newspaper.
   (i)   "Hauler" means any person, partnership, corporation or other public or private entity that provides for the collection of solid waste or recyclables from City residents, commercial establishments and large community events, and the transportation thereof to approved disposal facilities or facilities accepting recyclables. A hauler shall be certified as required by the West Virginia Public Service Commission (PSC).
   (j)   "Commercial establishment" means any commercial, industrial, institutional, educational or governmental establishment.
   (k)   "Large community event" means any event that is sponsored by public or private entities or individuals that includes, but is not limited to, festivals, fairs, bazaars, socials, picnics, performances and organized sporting events attended by 500 or more individuals per day.
