711.04 REQUIREMENTS FOR LICENSE; DUTIES OF LICENSEE; REVOCATION OR SUSPENSION OF LICENSE.
   (a)   Each person seeking a license hereunder after the effectve date of this section shall submit satisfactory evidence to the City Treasurer showing:
      (1)   That he has successfully completed the licensing requirements of West Virginia Code Article 19-2C;
      (2)   That he has a good reputation;
      (3)   That he is of trustworthy character;
      (4)   That he is a citizen of the United States; and
      (5)   That he has a general knowledge of the auctioneering profession and the principles involved in conducting an auction.
   (b)   Each licensee shall promptly produce for inspection such license at all sales conducted by or participated in by such licensee when requested to do so by any person and shall keep complete and accurate records of all transactions engaged in for a period of six months which records shall be open to inspection by the City Treasurer or his authorized representative.
   (c)   The City Treasurer may, by order, suspend or revoke any license granted hereunder for any violation of this article or for any of the following reasons:
      (1)   Obtaining a license through false or fraudulent representation;
      (2)   Making any substantial misrepresentation in any application for an auctioneer's license;
      (3)   Engaging in a continued and flagrant course of misrepresentation or for making false promises through an agent, advertisement or otherwise;
      (4)   Failing to account for or remit within a reasonable time any money belonging to others that comes into his possession;
      (5)   Being convicted in any court of competent jurisdiction of this State or any other state of a criminal offense involving moral turpitude or a felony or for failing to notify the City of any such convicition within fifteen days of conviction.
      (6)   Engaging in any conduct of an auctioneer which demonstrates dishonesty or incompetency;
      (7)   Engaging in any other conduct that constitutes fraudulent or dishonest dealing; and
      (8)   Acting as an attorney for a client;
      (9)   Failing to satisfy tax and other obligations imposed by this Part Seven - Business Regulation and Taxation Code;
      (10)   Upon the revocation of a license granted by the Commissioner of Agriculture of the State.
