A. Buildings where marijuana is stored or dispensed must be equipped with ventilation/air filtration systems so that no odors are detectable off premises.
B. The retail establishment must collect the sales tax of all State, County and City taxes that are applicable.
C. The hours of operation shall be between the hours of nine o’clock (9:00) A.M. to nine o’clock (9:00) P.M. Monday through Saturday. Operations shall be closed on Sundays, as well as, Christmas, Thanksgiving, July 4th and New Year's Day.
D. Any violations of this section will result in the revocation of the retail marijuana establishment permit.
E. It is the intent of the City of Wewoka that nothing in this chapter is constructed to:
1. Allow persons to engage in conduct that endangers or causes a public nuisance;
2. Allow the use of marijuana for non-medical purposes; or
3. Allow any activity that is otherwise illegal or not permitted by state law.
F. Separate Premises:
1. The premises of a retail package store shall be separated from the premises on which any other goods, wares, or merchandise are sold or services are rendered, by non-transparent walls which may be broken by a passageway to which the public is not admitted, for the purpose of selling, reselling, or delivering in connection with the sale of medical marijuana.
2. No person shall take any medical marijuana through any passageway described in this subsection for the purpose of selling or reselling such marijuana, or the purpose of delivery thereof in connection with a sale of such marijuana. (Ord. 511, 12-11-2018)
