8-4-6: CONTAINER AND DUMPSTER REQUIREMENTS; PLACEMENT:
   A.   Containers Provided By City; Placement: The city shall provide one mobile container to each resident on designated container routes. Containers are the property of the city and shall remain at the assigned location regardless of changes in ownership or occupancy of the residence.
   B.   Carry Out Service: Carry out service shall be provided to residents who are physically unable to place containers at curbside or alley. This service will be provided by city employees at no additional fees. The city reserves the right to require a doctor's certificate as proof of resident's inability to place the container at curbside or alley.
   C.   Use By Residents: In areas where mobile containers are provided by the city, residents shall use those containers as their first means of disposing of garbage. Pick up service will be limited to the mobile container, except as to the provisions of subsection G of this section.
   D.   Replacement Or Repair Of Containers:
      1.   Mobile containers that are stolen, destroyed, or damaged through abuse, neglect, or improper usage by the resident shall be repaired or replaced by the city at the expense of the resident or owner of the residence.
      2.   Mobile containers that are damaged through normal and reasonable usage will be repaired by the city at the city's expense.
   E.   Containers Property Of City: The container or containers shall remain the property of the city.
   F.   Businesses On Mobile Container Routes: Business collections on designated mobile container routes shall not be provided mobile containers, but shall use standard type containers as approved by the city code, unless use of poly-kart is authorized by the city administrator.
   G.   Private Ownership: Private ownership of mobile containers is governed by the following:
      1.   Residents may purchase one additional mobile container by placing a purchase order with the city utility billing office; and
      2.   The city will bill the resident fifty dollars ($50.00) for the costs, inclusive of assembly and delivery to residents. In the event payment is not received within thirty (30) days of billing date, the cost of the mobile container will be added to the garbage statement at the rate of ten dollars ($10.00) per month for a period of six (6) months.    H.   Business Or Industrial Establishments; Dumpsters:
      1.   Owners or operators of business or industrial establishments shall provide metallic or plastic containers commonly known as dumpsters, in sizes of one, two (2) or three (3) cubic yards, or other type containers approved by the city administrator. (1983 Code § 17-415; amd. 2005 Code)
      2.   The owner or operator of each business or industrial establishment shall provide containers for sanitation purposes of adequate size to properly provide for the accumulation of garbage, refuse and rubbish. The city, by and through its city administrator, shall prescribe for an adequate size container in the event the owner or operator of the business or industry fails to do so. The failure of the owner or operator of such business or industrial establishment to provide for containers of adequate size shall constitute an offense.
      3.   Those business or industrial establishments generating an inordinate amount of trash, or unable to provide proper container size, shall be assessed the maximum user fee.
      4.   All such containers shall be placed in a location so as to be easily accessible for collection. A solid hard surface shall be required for the approach to and upon which such container shall be placed.
      5.   Business establishments are authorized to operate a dumpster in conjunction with other users. All such businesses shall be assessed individually a minimum rate.
      6.   The city, through and by the city administrator, shall determine the number of pick ups and, when necessary, the size and number of dumpsters per business or industrial users. (1983 Code § 17-407)
   I.   Dumpsters Available For Rental Purposes: Any sanitation customer who accumulates large amounts of garbage or refuse in the process of remodeling, construction or other such activity may rent from the city a one yard dumpster for a fee as set by the city council, plus a normal rate as set by the council. Such customer shall be responsible and hold the city harmless for use of such dumpster. (1983 Code § 17-415)
