5-7B-2: NUISANCES:
   A.   Any person affected by a nuisance cited in subsection B of this section shall notify the animal control officer of the nuisance, and the animal control officer shall make an inspection to verify the complaint. The complainant shall be given the opportunity to file a written complaint with the animal control officer if the officer determines a nuisance exists. Following the receipt of a written complaint, the animal control officer may give the owner of the dog causing the nuisance a citation or a warning to mitigate the nuisance. Each day a nuisance exists shall constitute a separate offense.
   B.   A nuisance condition exists when the owner of a dog allows feces of such animal to accumulate, and, in the opinion of the animal control officer, causes odors and becomes offensive to smell and unsightly. (Ord. 479, 10-9-2012)
