A. Authority To Respond: The fire department, in accordance with any regulations the city council may prescribe, or if there are no regulations, in the discretion of the fire chief, may respond to calls outside the city limits. In answering calls outside the limits or performing fire prevention, rescue, resuscitation, first aid, inspection or any other official work outside the city limits, the department shall be considered an agent of the state and acting in a governmental capacity.
B. Nonliability Of City: The city shall not be liable for any act of commission, omission or negligence in answering, returning from or performing such work outside the limits. For responding to calls outside the city limits, the city shall be paid a fee as set by the city per equipment and per hour, to pay for expenses incurred by the city. (1983 Code § 13-206)
