In those instances of required fingerprint based investigations authorized by this chapter, a national criminal fingerprint based background check by the federal bureau of investigation (FBI) is authorized hereby. In addition, the subject of the fingerprint based investigation shall comply with any authorization or release required by the FBI in furtherance of any such investigation. In the event of any conflict herewith, any federal laws, policies or regulations concerning fingerprint investigations shall be controlling and the FBI or its representative may refuse to process any requests hereunder based upon such grounds. When required, fingerprint requests will be submitted to the state identification bureau and thereafter forwarded to the FBI for a national criminal history check. (Ord. 2009-02, 2-3-2009)
