3-3-12: USES, PURPOSES, AND ALLOCATION OF TRANSIENT LODGING TAX PROCEEDS:
The city council shall use the proceeds of the transient lodging tax provided by this chapter for the following use, uses, purpose or purposes, or any one or more thereof, at such times, in such amounts and in such manner as it shall determine from time to time. The transient lodging tax proceeds shall be allocated under the following categories and the allocation may be reviewed annually by the city council:
   A.   Except as otherwise provided herein, the city council shall use the revenue received from the provisions of this chapter for any and all lawful governmental purposes pursuant to the powers and authority given the city by Nevada Revised Statutes.
   B.   All proceeds from the one percent (1%) promotion of tourism transient lodging tax shall be paid as follows:
      1.   Three-eighths (3/8) of all proceeds of the tax must be paid to the department of taxation for deposit with the state treasurer for credit to the fund for the promotion of tourism.
      2.   Five-eighths (5/8) of all proceeds of the tax must be deposited with the Elko County recreation board created pursuant to Nevada Revised Statutes 244A.597 to be used to advertise the resources of the county of Elko related to tourism, including available accommodations, transportation, entertainment, natural resources and climate, and to promote special events related hereto.
   C.   The proceeds of the recreation fund transient lodging tax of up to one percent (1%) of the total of fifteen percent (15%) of the proceeds may, upon resolution of the city council of West Wendover, be donated to a validly established nonprofit entity to be used solely for the promotion of tourism and recreational facilities throughout the city of West Wendover.
   D.   The remaining balance of fourteen percent (14%) of the recreation fund transient lodging tax shall be assigned to the West Wendover recreation district, a general improvement district, for those purposes authorized by Nevada Revised Statutes 318.143. The West Wendover recreation district may irrevocably pledge the transient lodging tax proceeds assigned herein for: 1) the repayment of any bonds or short term obligations issued pursuant to chapter 318, 350 or 354 of Nevada Revised Statutes for any lawful purpose pertaining to the furnishing of recreational facilities; or 2) the refinancing of any such bonds or obligations. If any proceeds are pledged pursuant to this subsection for the purposes described herein, any such assignment of proceeds to the West Wendover recreation district may not be revoked until the bonds or obligations for which such proceeds were pledged have been completely repaid according to the terms thereof.
