(A) There shall be and there are hereby established for the services rendered by the town storm water utility the following rates and charges, during each monthly billing period:

(B) All ordinances and parts of ordinances in conflict herein are hereby repealed; provided, however, that the existing schedule of rates and charges shall remain in full force and effect until a tariff containing the schedule of rates and charges fixed by this section.
(C) The Town Council hereby authorizes the Council President and legal counsel for the Council to take any and all necessary steps to act on behalf of the Council to comply with any and all state agencies, regulations, and the Indiana Utility Regulatory Commission, if necessary, to comply with the law for the new rates and charges referenced herein. The town has opted out of the Indiana Utility Regulatory Commission; however, in the event the storm water utility comes under their jurisdiction said authorizations shall be permitted.
