(A) (1) Generally. There shall be and there are hereby established for the services rendered by the town waste water utility, the following rates and charges, during each monthly billing period:

(2) Single-residential home customers. All single-residential customers shall be charged the same base rate. Said base rate shall be calculated based on the meter size at three-fourths-inch meter.
(3) Non-meter waste water utility customers. All non-meter waste water utility customers shall be billed a fixed rate. For users of the waste water utility that are unmetered water users or accurate meter readings are not available, the monthly charge shall be determined by equivalent single-family dwelling units, except as herein provided. Waste water bills shall be rendered once each month (or period equaling a month). The schedule on which said rates and charges shall be determined as follows:

(4) Connection charges. Each user at the time he or she is connected for the first time with the waste water system shall pay $750. There shall be a $25 inspection fee.
(5) Deposit. There shall be a $125 deposit on each new account. The deposit will only be applied to an account after the account has been declared more than 60 days in arrears and the customer has moved from the residence. The town will not allow the use of the deposit as payment for any regular bill from the waste water utility.
(B) All ordinances and parts of ordinances in conflict herein are hereby repealed; provided, however, that the existing schedule of rates and charges shall remain in full force and effect until a tariff containing the schedule of rates and charges fixed by this section.
(C) The Town Council hereby authorizes the Council President and legal counsel for the Council to take any and all necessary steps to act on behalf of the Council to comply with any and all state agencies, regulations and the Indiana Utility Regulatory Commission, if necessary, to comply with the law for the new rates and charges referenced herein. The town has opted out of the Indiana Utility Regulatory Commission; however, in the event the waste water utility comes under their jurisdiction said authorizations shall be permitted.
