§ 52.01  RATES AND CHARGES.
   (A)   There shall be and there are hereby established for the services rendered by the town water works system, the following rates and charges, during each monthly billing period:
      (1)   Metered user block schedule. For use of and rendered by the waterworks system for the town, based upon the use of water supplied by said waterworks system:

      (2)   Connection charges.
         (a)   Each user at a the time he or she is connected with the waterworks system shall pay a charge to cover the costs of: excavating and tapping the main; furnishing and installing service pipe from the main to the lot line; furnishing and installing corporation and stop cocks; and furnishing and installing meter cock (if outside), yoke and meter.

         (b)   The charge for a tap larger than the one-inch meter shall be the cost of labor, materials, power machinery, transportation, road boring and/or road cutting, and overhead incurred for installing the tap, but shall not be less than the applicable charge for a one-inch meter tap.
   (B)   The utilities office, located at Town Hall, is responsible for the billing of water, waste water and storm water. The office is open Monday through Friday 8:00 a.m. to 4:00 p.m. and customers should contact the office during normal business hours. If an emergency exists regarding service after business hours please call 812-533-1053.
   (C)   Servicing policy:
      (1)   You will need to bring:
         (a)   Two forms of I.D. (one being picture); and
         (b)   If renting: lease or rental agreement; or
         (c)   If buying: proof of purchase or purchase agreement.
      (2)   Shut-off fee: $40.
      (3)   Deposits:
 
    $125 Deposit

      (4)   Transfer of deposit: $15 transfer fee.
      (5)   Qualifications:
         (a)   Good credit history; and
         (b)   Turn off of present address within same week as turning on new service address.
      (6)   Deposit policy: the deposit will only be applied to an account after the account has been disconnected. We will not allow use of the deposit as payment for any designated bill from said utilities.
   (D)   All ordinances and parts of ordinances in conflict herein are hereby repealed; provided, however, that the existing schedule of rates and charges shall remain in full force and effect until a tariff containing the schedule of rates and charges fixed by this section.
   (E)   The Town Council hereby authorizes the Town Council President and legal counsel for the Council to take any and all necessary steps to act on behalf of the Council to comply with any and all state agencies, regulations and the Indiana Utility Regulatory Commission, if necessary, to comply with the law for the new rates and charges referenced herein. The town has opted out of the Indiana Utility Regulatory Commission; however, in the event the water works utility comes under their jurisdiction said authorizations shall be permitted.
   (F)   The rates and charges may be billed to the tenant or tenants occupying the properties served, unless otherwise requested in writing by the owner, but such billing shall in no way relieve the owner from the liability in the event payment is not made as herein required. The owners of properties served, which are occupied by a tenant or tenants, shall have the right to examine the collection records of the town for the purpose of determining whether bills have been paid by such tenant or tenants, provided that such examination shall be made at the office at which said records are kept and during the hours that such office is open for business.
