§ 36.20  DISCIPLINARY ACTION.
   The town will immediately terminate any employee with tests results as follows.
   (A)   If the test as reviewed and confirmed by the medical review officer (MRO) results show a forensically acceptable positive quantum of proof (in conformance with the levels established by the D.H.H.S. for initial tests and confirmatory tests) of cocaine, heroin, PCP, LSD, barbituates, amphetamines or any other controlled substance except marijuana, the employee shall be immediately discharged.
   (B)   With regard to marijuana, if the test results as reviewed and confirmed by the medical review officer (MRO) of a urine specimen by gas chromatograph/mass spectrometry (GCIMS) confirm the initial immunochemical quantification of 50 or more nanograms crossreactive cannabinoids/ml, the employee shall be immediately discharged.
   (C)   If the test results as reviewed by the certified operator and medical review officer (MRO) show an EBT/alcohol concentration equal to or above four hundredths, the employee shall be immediately discharged. If the test results show an EBT/alcohol concentration equal to or above two hundredths, but less than four hundredths, the employee shall be removed from duty for 24 hours without pay, but with no other disciplinary action.
