(A) Definitions. As used in this section:
CONSUMING or CONSUMPTION. Ingesting or placing a tobacco product or other combustible plant material or vape product into one's mouth.
SMOKE or SMOKING. Inhaling, exhaling, burning, or carrying any lighted cigar, cigarette, pipe, or other smoking device for burning tobacco or other plant.
VAPE or VAPING. VAPE is a device that heats up a liquid to create a vapor you inhale, including, but not limited to. pens. e-cigarettes. and hookahs. VAPING means the inhaling or exhaling of the vapor produced by a vape or similar device.
(B) No person shall engage in smoking, vaping, or consuming tobacco products, marijuana, or combustible plant material, or liquids at or within 50 feet from any park, building or structure, including, but not limited to, any ingress and egress access points to such park or building, such as sidewalks, driveways and parking lots.
(C) Whoever violates this section is guilty of a minor misdemeanor.
(D) Lack of intent to violate this section shall not be used as a defense to a violation of this section.
