100.06(A) Activities that require a
event permit. The shall require a special event permit for any event, meeting, activity, gathering, or assembly of a group of , having a common purpose, design or goal, held upon any
in a nonresidential Area, where
(i)
the event substantially inhibits the usual flow of pedestrian or vehicular on the surrounding , including but not limited to Streets,
, alleys, and
, or preempts use by the general public,
or (ii) is
anticipated to attract 50 or more .
No permit shall be required if the event, meeting, activity, gathering or assembly is the usual and customary use of the
.
100.06(A)(1) The maximum duration of such events shall be three days. An event shall include but not be limited to festivals,
, concerts, parades, walks, races, fundraising sales and similar gatherings, grand opening promotions,
co-sponsored events and other similar events not specifically permitted by
ordinance.
100.06(A)(2) Events held on
, having no impact on
or the public as described in this subsection, that include a tent or any other temporarily erected
, shall require the appropriate
(s) and review and approval of the Fire Marshal.
100.06(A)(3) The maximum number of such events shall be one per
per month. If an additional application for a
event permit is submitted, a major site plan amendment shall be required.
100.06(A)(4) When there is permitted exterior
within the
, such events shall be held at a minimum of fifty feet from the perimeter of an exterior
site.
100.06(B) Limitations on special
events.
100.06(B)(1) Mechanical rides. All mechanical rides are prohibited at special
events.
100.06(B)(2)
. Privately owned, profit-oriented
are prohibited at special
events if they are not intended to directly benefit local educational, charitable, rehabilitative, recreational, or religious organizations consisting largely of resident citizens of the , where any profits realized are to be channeled into local religious, charitable, educational, rehabilitative, or recreational usage of direct benefit and impact to the citizens of the .
100.06(B)(3) Recreational vehicles. If recreational vehicles are to be utilized in connection with an event, a parking plan for such recreational vehicles shall be required. The plan shall be subject to approval, which shall be in the sole discretion of the . The number of recreational vehicles that may be parked shall be limited to a reasonable amount and duration. A proper plan of sanitary disposal, in compliance with F.S. § 513.08, and all other applicable , shall be required. The parking of recreational vehicles shall be in compliance with the ’s parking regulations and they shall not obstruct .
100.06(B)(4) Portable lighting. If a portable lighting system is to be utilized for an event, a plan for the usage of such portable lighting system shall be required. The plan shall be subject to approval, which shall be in the sole discretion of the . The portable lighting system shall not adversely affect the neighboring properties and shall be consistent with the applicable provisions in § 124.52 of this Code.
100.06(B)(5) Outdoor Sales of certain goods. Outdoor sales of secondhand or used goods are prohibited at Special
events.
100.06(C) Seasonal Sales Permits.
100.06(C)(1) Seasonal sales permits may be issued to an
for special seasonal sales activities that are conducted for a period not to exceed 30 calendar days in length conducted on
.
100.06(C)(2) General criteria and limitations for seasonal sales permits shall be as follows:
100.06(C)(2)(a) The activity must be compatible with the existing surrounding land
, the Zoning Chapter and the Comprehensive Plan; no seasonal sales permits shall be issued for events in areas zoned for
residential.
100.06(C)(2)(b) No seasonal sales permit shall be approved when a merchant exists who deals in the goods offered by the temporary use and whose principal business is located within the same center or within 300 feet of the proposed location of the temporary use.
100.06(C)(2)(c) If
parking is to be utilized, permission must be in writing from the
of said property.
100.06(C)(2)(d) An
may not receive a seasonal sales permit more than three times within a
, unless approved by the
.
100.06(C)(2)(e) No more than two seasonal sales permits may be issued at one period of time, unless approved by the
.
100.06(C)(2)(f) An
must submit an affidavit that permission has been secured from the
of the land upon which the seasonal sale is to be held.
100.06(C)(2)(g) If recreational vehicles are to be utilized in connection with a seasonal sales activity, a parking plan for such recreational vehicles shall be required. The plan shall be subject to
approval, which shall be in the sole discretion of the
. The number of recreational vehicles that may be parked shall be limited to a reasonable amount and duration. A proper plan of sanitary disposal, in compliance with F.S. § 513.08, and all other applicable
shall be required. The parking of recreational vehicles shall be in compliance with the
’s parking regulations and they shall not obstruct
.
100.06(C)(2)(h) If a portable lighting system is to be utilized for a seasonal sales activity, a plan for the usage of such portable lighting system shall be required. The plan shall be subject to
approval, which shall be in the sole discretion of the
. The portable lighting system shall not adversely affect the neighboring properties and shall be consistent with the applicable provisions of § 124.52 of this Code.
100.06(D) Permit Procedures. The permit procedures applicable to special event and seasonal sales activities on
are set forth in this Chapter 100.
100.06(E)

shall be obtained.
100.06(F) Noise. The activities that require a special
event permit or a seasonal sales permit shall be governed by the noise regulations in Chapter 52 of the
. Additionally, the activities may be subject to additional specific limitations on noise as set forth in the permit, violations of which shall constitute grounds for immediate revocation of the permit by the .
