1379.01 PROXIMITY OF BUILDINGS TO PUBLIC WAYS.
   No building or structure of any kind, or any fence or wall, shall be built so as to encroach upon the line of any street, lane, alley or public ground, except in the case of posts or piers of a fence or wall, or sprinkler pipes and appurtenances which may be allowed to extend beyond the line of such street, lane, alley or public ground a distance not to exceed six inches.
   Any person who constructs posts or piers of a fence or wall, or sprinkler pipes and appurtenances within the City right of way shall do so at their own risk. The City shall assume no responsibility whatsoever for damages done to such installations. In the event that any part of such right-of-way is excavated for the installation of utilities, storm or sanitary sewers, curbs, sidewalks or any other types of installations to be constructed by the City in such right-of-way to the posts or piers of a fence or wall, or sprinkler pipes and appurtenances shall be the responsibility of and borne by the property owner or his successors in title.
