1367.07 CHANGE OF GRADE; PLAN REQUIRED; APPROVAL.
   No owner of property from which topsoil or loam is to be removed shall be issued a permit for such removal if such owner lowers or raises the grade of such property without first submitting a plan to the Director of Engineering through the Director of Inspections for approval. The plan shall be in such detail as is required by the Director of Engineering and shall indicate topographical features before and after removal of the topsoil. Approval by the Director of Engineering shall be denied if the removal of topsoil would adversely affect the storm water drainage or so obstruct culverts, covered drains or private property laid in any natural watercourse, creek, brook, branch or swale that the water naturally flowing therein would flow back, or that stagnant water or other conditions prejudicial to the health, comfort or convenience of any resident in the area would be created.
