It shall not be deemed a violation of Section 1337.01 when the act of obstructing, impeding, diverting, enclosing or varying the location, direction, size or capacity of a drain, ditch, drainage ditch, culvert, sewer, natural or other watercourse, or depression or conduit is done pursuant to a permit issued by the Director of Engineering expressly authorizing such action, provided the permittee has followed the directions of such official in the work done.
