Whoever violates any provision of this chapter for the first time shall be guilty of a fourth degree misdemeanor, and the minimum penalty shall be a fine of two hundred dollars ($200.00), no portion of which may be suspended. Whoever violates any provision of this chapter for a second or subsequent time shall be guilty of a third degree misdemeanor and the minimum penalty shall be a fine of not less than four hundred dollars ($400.00), no portion of which may be suspended and imprisonment for not less than thirty days, with no more than twenty-five of the thirty days to be suspended.
