(a) No person shall sell or offer to sell in the parks or on or from the streets, sidewalks, alleys or other public properties within the City, or from any motor vehicle or other type of vehicle, whether motor propelled or otherwise, located upon any park, street, sidewalk, alley or other public property within the City, any goods, merchandise, food or other article or thing for human consumption or any goods, merchandise, medicine, foodstuffs, produce or other article or thing, whether for human consumption or otherwise.

(b) The provisions of this section shall not apply to:
(1) The sale of produce from any stand constructed or existing off the traveled portion of any street, highway or sidewalk within the City and for which a permit is issued;
(2) Sales of food or merchandise of any kind by or under the auspices of the Board of Education of the Westlake School District, or any department or affiliate thereof, upon school property;
(3) Sales of food or merchandise of any kind by the City upon City property; or
(4) The operation upon City property of such concession stands or similar facilities as may from time to time be authorized by Council.

(c) Whoever violates any of the provisions of this section is guilty of a minor misdemeanor. A separate offense shall be deemed committed each day during or on which the violation occurs or continues.
