§ 94.99 PENALTY.
   (A)   Unless otherwise specifically provided, violation of any provision of this code of ordinances shall subject the offender to a civil penalty (see civil penalties below), to be recovered by the town. Violators shall be issued written notice of the violation which must be paid within 30 days after a receipt of the notice. If the violator does not pay the penalty within 30 days, the town may recover such penalty, and all subsequently accruing penalties, in a civil action.
   (B)   Each day’s continuing violation of any ordinance provision shall be a separate and distinct offense.
   (C)   Notwithstanding division (A) above, all ordinances may also be enforced by appropriate equitable remedies issuing from a court of competent jurisdiction.
   (D)   If any division of this section is held to be invalid or unenforceable, all other divisions shall nevertheless continue in full force and effect.
   (E)   Civil penalties. A violation of this chapter shall subject the violator to an initial civil penalty in the amount of $200 with an additional $100 for each day’s continuing violation of any ordinance provision; provided, that subsequent violations within any 12-month rolling period shall subject the violator to the following civil penalties: a second violation in any rolling 12-month period shall subject the violator to a civil penalty in the amount of $200 with an additional $100 for each day’s continuing violation of any ordinance provision, and a third and any subsequent violation in any rolling 12-month period shall result in the assessment of a $500 civil penalty.
   (F)   Criminal penalties. A person committing more than two violations of this chapter during any rolling 12-month period shall also be guilty of a Class 3 misdemeanor and shall be fined not more than $500, in addition to the civil penalties imposed.
