921.06 PROTECTION FROM ACCIDENTAL DISCHARGE.
    (a)   Each industrial user shall provide protection from accidental discharge of prohibited materials or other wastes regulated by this chapter. Facilities to prevent accidental discharge or prohibited material shall be provided and maintained at the owner’s or operator’s own cost and expense. Detailed plans showing facilities and operating procedures to provide this protection shall be submitted to the Public Service Director for approval and for review before construction of the facilities. Review and approval of such plans and operating procedures shall not relieve the industrial user from the responsibility to modify his facility as necessary to meet the requirements of this chapter.
 
   (b)   Users shall notify the Public Service Director immediately upon the occurrence of a slug or accidental discharge of any materials or wastewaters in noncompliance with this chapter or applicable Wastewater Discharge Permit conditions. This notification shall be followed within five (5) days of the date of occurrence, by a detailed written statement describing the cause of the discharge and the remedial measures taken to reduce the possibility of recurrence. Such notification shall not relieve the User of any liability for any expense, loss, or damage to the POTW.
 
   (c)   Any User which experiences an upset condition which results in an unintentional or temporary state of noncompliance with this chapter or Wastewater Discharge Permit conditions due to factors beyond reasonable control shall inform the Public Service Director as soon as possible, but not later than twenty-four (24) hours after the beginning of the upset. Where information is given orally, the User shall file a written report with the Public Service Director within five (5) days. The report shall include:
      (1)   A description of the incident, its cause, and its impact on the User’s compliance status;
      (2)   The duration of noncompliance, including exact dates and times of noncompliance. If the noncompliance continues, the time by which compliance is reasonably expected to be attained; and
      (3)   All steps taken or to be taken to reduce, eliminate, or prevent recurrence of the conditions of noncompliance.
 
   (d)   Bypasses of pretreatment facilities are prohibited and the Village may pursue enforcement action unless the user receives prior written approval for bypass from the Village.
 
   (e)   All Industrial Users shall notify the Village in advance of any substantial change in the volume or character of pollutants in their discharge. (Ord. 99051. Passed 8-16-99.)
