921.03 USE OF PUBLIC SEWERS.
   (a)   It shall be unlawful to discharge into any natural outlet within the Village of West Jefferson, Ohio, or in any area under the jurisdiction of said Village, any wastewater or other polluted waters.
 
   (b)   It shall be unlawful to construct or maintain any privy, privy vault, septic tank, cesspool, or other facility intended or used for the disposal of wastewater without first obtaining the required permits from the Village.
 
   (c)   No person, firm, or corporation shall discharge or cause to be discharged any storm water, groundwater, roof runoff, subsurface drainage, cooling water, or unpolluted industrial process water to any sanitary sewer.
 
   (d)   It shall be unlawful to discharge into the building sanitary sewer the surface water which collects in basement or foundation excavations. If the building sanitary sewer is complete before the plumbing can be connected thereto, the builder or sewer tapper shall keep the end of the building sanitary sewer tightly closed with a plumber’s plug or other watertight plug.
 
   (e)   The owner(s) of all houses, buildings, or properties used for human occupancy, employment, recreation, or other purposes, situated within the Village and abutting on any street, alley, or right-of-way in which there is now located or may in the future be located a public sanitary or combined sewer of the Village, is hereby required at the owner’s expense to install suitable toilet facilities therein, and to connect such facilities directly to the proper public sewer in accordance with the rules and regulations within 90 days after date of official notice to do so, provided the foundation wall of the structure from which sewage or other wastes originated is less than 250 feet from the nearest boundary of the right-of-way within which the sewer is located.
 
   (f)   No person, firm, or corporation shall be permitted to connect to or discharge wastewater to the Village sewage system unless it has been determined by the Village that there is sufficient capacity in the system to collect, convey, and treat the proposed wastewater discharge of such person, firm, or corporation.
 
   (g)   All new or replacement sewers that are now connected to or that will be connected to the Village sewage collection system and thereby discharging to the wastewater treatment plant shall be constructed in accordance with the specifications designated in Ordinance No. 72-1711 of the Village of West Jefferson.    (h)   It will be the owner’s responsibility to maintain and keep in good repair, all sewer laterals serving the owner’s dwelling house, building or other structure. In the event said owner fails to properly maintain or keep in repair said sewer lateral, the Director of Public Service shall notify said owner of the deficiency or need of repair to said lateral. The owner shall make all necessary repairs to said lateral within thirty (30) days of receiving said notice from the Public Service Director. In the event that said owner fails to make such necessary repairs, the Village shall cause said repair to be made either by employees of said Village or by private contractor, whichever the Public Service Director determines is the most efficient method of correcting said defect. The cost of said repairs shall be charged to the owner and shall be deemed a part of the rate or charges as authorized by Ohio R.C. 729.49.
