705.01 AMUSEMENT DEVICE LICENSE; FEE; EXCEPTIONS; PENALTY.
   (a)   License Required. From and after the effective date of this section, it shall be unlawful for any person, firm or corporation to exhibit, display or offer for public use within the corporate limits of the Village any music or juke box, any pin ball machine, or other automatic coin amusement machine unless and until the owner of such machine or device has applied for and obtained a written license issued as hereinafter provided, and which license shall be displayed on such machine or device.
   (b)   Application; Fee. The applicant for such license shall complete an application form for such license to be furnished by the Village, setting forth in such application the name and address of such applicant, a statement of ownership of such machine or device, the number of machines or devices for which application is made, and such other matters as shall be required by the Village. A separate license for each machine or device shall be issued. All licenses shall be issued by the Mayor. No license shall be issued by the Mayor unless and until there is deposited with said Mayor the sum of thirty dollars ($30.00) for the first machine or device and fifteen dollars ($15.00) for each additional machine or device. All licenses shall be issued annually to expire on December 31st of the year for which said license is issued. All licenses shall be exhibited in plain sight on each machine for which the same has been issued.
   (c)   Exceptions. This section shall not apply to any machine or device designed for use solely to dispense merchandise or products sold such as stamp dispensing machines, cigarette machines, gum machines, or other similar machines designed solely for the purpose of dispensing merchandise or products sold in the ordinary course of business.
   (d)   Prohibited Devices. No person, firm or corporation shall operate or permit to be operated in any place of business within the corporate limits of the Village any machine or device for which no license has been issued as provided herein.
   (e)   Penalty. Whoever violates this section is guilty of a minor misdemeanor for each offense. For the purposes of this section, each day during any part of which day any such machine or device is exhibited, displayed or offered for use by the public by any owner or operated by any owner or any other person shall constitute a distinct and separate offense.
   (f)   Operation of Illegal Devices. All other provisions to the contrary notwithstanding, this section shall not be construed to make legal or proper the operation of any machine or device, the operation of which is contrary to the laws of the State of Ohio or of the United States of America, and should any license be issued for such a machine or device, such license may be revoked by the Mayor of said Village upon the payment to the recipient of such license of the original license fee charged for the last annual license. All license fees charged by the Village for periods which have been expired prior to the determination that such machine or device is illegal or contrary to state or federal law shall be deemed forfeited.
