(a) No person, firm or corporation being the owner or possessor of any real estate situated within the corporate limits of the Village shall dump or deposit on such land or otherwise fill the same with any materials other than the following: soil, stone, gravel, cement, ashes, brick or other masonry materials.
(b) In all cases in which fill is made upon private property and where such area filled is not intended to be covered by the erection of a building or surfaced with cement, blacktop or other permanent surface materials, it shall be unlawful to fill such land unless at least fertile soil, having a depth of at least eight inches is deposited on the surface of such fill.

(c) Whoever violates this section shall be guilty of a misdemeanor of the fourth degree.
