(a) Business or private property owners desiring that no skateboards or skateboarding is to be on their property shall post a sign(s) stating: “NO SKATEBOARDS ALLOWED ON THIS PROPERTY.” The signs must be in locations which can be seen from any part of the property.
(b) The owner of the property shall also send a letter to be kept on file in the West Jefferson Police Department which shall include the statement, “The West Jefferson Police Department is authorized and directed to enter onto my property at for the purpose of enforcing West Jefferson laws and ordinances.”
(c) Action that the property owner can take: determine the identity of the violator(s) then contact the police and file a complaint. Or, call the Police Department and request an officer to respond.
(d) If, when the officer arrives the offender(s) is still on the private property with the skateboard, he shall take the following action:
(1) Obtain the offender’s name and address;
(2) Determine if the offender is a juvenile or adult;
(3) Keep both of the above on record on an incident report;
(4) If the offender is an adult, the officer, at his discretion shall warn or cite the offender;
(5) If the offender is a juvenile, the officer shall determine if the offender is on probation and if so, file a probation violation report;
(6) If the offender is a juvenile not on probation, the officer at his discretion, shall either warn the juvenile or file a delinquency report;
(7) Officers on patrol shall also monitor private property which is so posted and shall stop and take action as described in subsection (d) hereof.
