(A) As a condition of final approval of a subdivision plat or site plan, or as a condition for the issuance of a building permit for private, commercial, industrial, or public use development, the owner, developer, or builder shall pay impact fees, which amounts have been set by ordinance by the City Council.
(B) Exemptions. The City Manager or designee may grant an exemption or elimination for the payment of impact fees for newly constructed moderate income housing units and accessory dwelling units.
