§ 10.02 DEFINITIONS AND RULES OF CONSTRUCTION.
   In the construction of this code and of all ordinances passed by the City Council, the following definitions and rules shall be observed, unless such construction would be inconsistent with the manifest intent of the Council. For the purpose of this code, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   CITY. The City of Westfield, Indiana, or the area within the territorial limits of the outside of the city over which the city has jurisdiction or control by virtue of any constitutional or statutory provision.
   CODE. Whenever the term CODE or THIS CODE is referred to without further qualification, it shall mean the Code of Ordinances, City of Westfield, Indiana, as designated in § 10.01.
   COUNCIL, CITY COUNCIL. The City Council of the City of Westfield, Indiana.
   COUNTY. The County of Hamilton, State of Indiana
   GENDER. Each gender includes the masculine, feminine and neuter genders.
   I.C. The Indiana Code, as now or hereafter amended.
   LAW. Denotes applicable federal law, the Constitution and statutes of the State of Indiana, the ordinances of the city and, when appropriate, any and all rules and regulations which may be promulgated thereunder.
   MAY. Is permissive.
   MONTH. A calendar month.
   MUST, SHALL. Each are mandatory.
   NUMBER. The singular number includes the plural and the plural includes the singular.
   OATH. The term OATH includes an affirmation, and the words SWEAR and SWORN shall be equivalent to the words AFFIRM and AFFIRMED.
   OR, AND. The term OR may be read AND, and the term AND may be read OR, if the sense requires it.
   OWNER. When applied to a building or land, includes any part owner, joint owner, tenant in common, joint tenant, tenant by the entirety of the whole or a part of such building or land.
   PERSON. Includes a natural person, joint venture, joint stock company, partnership, association, club, company, corporation, business, trust, organization, or the manager, lessee, agent, servant, officer or employee of any of them.
   PERSONAL PROPERTY. Includes money, goods, chattels, things in action and evidences of debt.
   PRECEDING, FOLLOWING. The next before and next after, respectively.
   PROPERTY. Includes real and personal property.
   REAL PROPERTY. Includes lands, tenements and hereditaments.
   SIDEWALK. The part of a street between the curblines, or the lateral lines of a roadway, and the adjacent property lines intended for the use of pedestrians.
   STATE. The State of Indiana.
   STREET. The entire width between the boundary lines of every way publicly maintained when any part of the way is open to the use of the public for purposes of vehicular travel. The term includes an alley.
   TENANT, OCCUPANT. When applied to a building or land, include any person who occupies the whole or a part of such building or land, whether alone or with others.
   TENSE. Words used in the present tense include the past and the future tenses and vice versa, unless manifestly inapplicable.
   TITLE OF OFFICE. Use of the title of any officer, employee, department, board, commission or agency means that officer, employee, department, board, commission or agency of the city.
   WRITTEN, IN WRITING. Include printing, lithographing or other mode of representing words and letters.
   YEAR. A calendar year.
