§ 30.01 TOWN BECOMING A CITY; ADOPTING SECOND CLASS CITY STATUS.
   (A)   (1)   The Town of Westfield, Indiana is a duly formed municipal corporation within the State of Indiana. The Town Council has enacted the appropriate legislation to convert the Town of Westfield into the City of Westfield effective January 1, 2008.
      (2)   All acts undertaken by the Town of Westfield, its boards, commissions, committees shall be deemed to have been undertaken by the City of Westfield.
   (B)   (1)   The City of Westfield has attained a population in excess of 35,000 persons.
      (2)   I.C. 36-4-1-1.1 provides that the legislative body of a third class city may, by ordinance, adopt second class city status. The Common Council adopts second class city status for the City of Westfield.
      (3)   Under the guidelines in I.C. 36-4-6-3, the Council shall pass an ordinance dividing the city into six Common Council districts, which includes at-large districts. The districts shall be effective for the term of the Council members beginning in January 1, 2028, shall be made in accordance with law, shall be based upon the latest decennial census, and shall not cross precinct boundaries.
      (4)   Upon the city becoming a second class city, all ordinances, rules and regulations of the city shall continue in full force and effect, except where inconsistent with a second class city powers, until amended or repealed, or unless inconsistent with state law.
      (5)   Before January 1, 2028, and under the city’s current budget procedures, the city’s executive shall establish a budget for the newly created appointed position and executive Department of the Controller.
      (6)   Before January 1, 2028, and under the city’s current budget procedures, the Common Council shall establish a budget for the elected position of Clerk of the city.
