§ 34.080 OPEN BURNING.
   (A)   Open burning is prohibited unless authorized and conducted in accordance with the requirements contained in 326 I.A.C. 4-1, 675 I.A.C. 22, and this section.
   (B)   In addition to the material restrictions identified in § 307.2.1 of the 2014 Indiana Fire Code, burning of leaves shall be strictly prohibited within the corporate boundaries of the city.
   (C)   In accordance with § 307.2 of the 2014 Indiana Fire Code, the city’s Fire Department must be notified prior to commencement of open burning. To obtain approval to commence open burning under § 307.1 of the 2014 Indiana Fire Code, the Division of Fire and Life Safety shall perform a site visit and approve a permit issued by the department authorizing the burning.
   (D)   (1)   Due to the risks related to the methods of open burning the Division of Fire and Life Safety may require certain procedures to guarantee public safety including, but not limited to:
         (a)   Standby fire personnel;
         (b)   Standby fire apparatus and equipment; and
         (c)   If the proposed burning would constitute a hazardous condition, increased minimum separation distances and/or specific burning containers.
      (2)   The financial costs associated with these additional requirements shall be the responsibility of the petitioner.
