§ 34.044 IMMINENT DANGER.
   The Fire Chief, or the Fire Chief’s designee, may stop an operation or require the evacuation with the approval of the State Fire Marshal of any Class 1 structure or portion thereof under the provisions of I.C. 36-8-17-9 when it is determined that conduct or conditions of the property:
   (A)   Present a clear and immediate hazard of death or serious bodily injury to any person other than a trespasser;
   (B)   Is prohibited without a permit, registration, certification, authorization, variance, exemption or other license required under I.C. 22-14, another state statute or rule of the Commission; or
   (C)   Will conceal a violation of law.
