(a) The Mayor of the Village may issue one license for a residential trash collector to operate within the Village for a period not to exceed three years in duration.
(b) Only one license shall be issued and outstanding at any one time.
(c) The Mayor may competitively bid, for the benefit of all village residents, for residential trash collection services to collect and dispose of the residential trash generated by residents, or the Mayor may negotiate with the then current licensee for commercially reasonable terms subject to the approval of Council.
(d) A bond or other financial guarantee shall be required of the selected residential trash collector prior to the issuance of the license. The amount of the bond or other financial guarantee shall not be less than ten thousand dollars ($10,000) and shall ensure performance under the license as well as protect the Village and residents from property damage caused by the residential trash collector.
(e) The Mayor may establish rules and regulations governing the trash collection activities and said rules and regulation shall have the same force and effect as an ordinance duly adopted by the Village.
(f) The Mayor is authorized to revoke the license granted under this section for non-compliance with any ordinance, rule or regulation or the failure of the residential trash collector to perform its services in a satisfactory manner.
(g) In the event that the license is to be revoked, the Mayor shall conduct a public hearing prior to such revocation and provide the licensed residential trash collector with ten days written notice of said hearing. The licensed residential trash collector may appear in person or by counsel and call witnesses or provide other evidence for consideration. The decision of the Mayor, whether or not to revoke the license, may be appealed to Village Council and by a two-thirds majority Council may override the decision of the Mayor.
