(a) Between the hours of darkness or 7:00 p.m., whichever is later, and dawn, no minor under the age of twelve years shall loiter, idle, wander, stroll, play or be present in or upon any public street, highway, road, alley, park, playground or other public ground, public place or public building, place of amusement or entertainment, vacant lot or other lot or parcel of land which is not such minor's place of residence, or any other unsupervised place within the Village.
(b) Between the hours of 11:00 p.m. and 6:00 a.m. of the following day, no minor between the age of twelve years and seventeen years shall loiter, idle, wander, stroll, play or be present in or upon any public street, highway, road, alley, park, playground or other public ground, public place or public building, place of amusement or entertainment, vacant lot or any other lot or parcel of land which is not such minor's place of residence, or any other unsupervised place within the Village.
(c) This section shall not apply:
(1) To a minor accompanied by his or her parent, guardian or other adult person having the care and custody of the minor;
(2) When the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian or other adult person having the care and custody of the minor; or
(3) When a minor is legally employed, while going directly between his or her residence and place of employment or when the minor is in a public place during curfew hours during the course of his or her employment.
(d) No parent, guardian or other person having legal custody and/or control of a minor shall permit such minor to violate division (a) or (b) of this section.
(e) Whoever violates division (a) or (b) of this section shall be dealt with in accordance with Juvenile Court law and procedures, as set forth in Ohio R.C. Chapter 2151.
(f) Whoever violates division (d) of this section is guilty of a minor misdemeanor and shall be subject to the penalty provided in Section 698.02.
