No building enlarged, extended, altered or erected within the City shall be used or occupied in whole or in part until a certificate has been issued by the Building Official certifying that the work has been completed in accordance with the provisions of an approved building permit and applicable ordinances. However, upon request of the owner or owner’s representative, the Building Official may issue a conditional certificate of occupancy before the completion of the entire work, provided the Building Official determines that the building or portions of the building can be safely occupied prior to the completion of the building. The conditional certificate of occupancy shall indicate the extent of the areas approved for occupancy and any time limits for completion of the work.
(a) The owner or the owner’s representative, contractor, and the person or company to occupy the building under a conditional certificate of occupancy shall additionally execute a written agreement with the City. In the event the remaining work is not completed and approved within the time limits established by the Building Official in the conditional certificate of occupancy, the permit holder shall be deemed in violation of this section and subject to the penalty provided in Section 1321.99, and Building Official may order the person or company occupying the building to vacate the building.
(b) The permit holder shall post a cash bond with the City in an amount to be determined by the Building Official. The cash bond shall be returned conditioned upon the completion of the remaining work.
(c) The permit holder shall pay a two hundred dollar ($200.00) non-refundable fee for the conditional certificate of occupancy.
