8-4-6: EMERGENCY PROVISIONS:
Notwithstanding any other provision of this chapter, the director of the building and development department may order the removal of any newspaper dispensing device from public property after finding that, because of its location or condition, the device poses an immediate threat to the health, safety and welfare of the public or a member thereof and the removal may occur without prior notice to the permittee. In this event, the village shall send written notice of the removal order to the permittee by certified mail. A hearing before the village manager shall be held, upon the written request of the permittee within three (3) business days following the village's receipt of the permittee's request, for the purpose of determining whether there is a continued need for the removal. The village manager shall issue a ruling immediately at the time the hearing is concluded. This decision is appealable pursuant to the provisions of subsection 8-4-7B of this chapter.
