7-2-1: LICENSE REQUIRED; ELIGIBILITY IF DEBT OWED TO VILLAGE:
   A.   Owner To Be Licensed: It shall be unlawful for any resident of the Village to own a motor vehicle (registered to a resident at an address in the Village), or for any person to use a motor vehicle owned by a resident of the Village, within the Village, unless the owner of such vehicle is licensed for the current year by the Village to use the same, and said license is displayed on the windshield of the motor vehicle. If an application for a state vehicle registration represents, or a state vehicle registration database identifies, that the owner of the vehicle resides within the corporate boundaries of the Village, that shall be deemed to be proof of these facts for the purposes of this Section.
   B.   Vehicle To Be Licensed: It shall also be unlawful for any motor vehicle which has its situs or base within the Village (a motor vehicle leased by a resident of the Village and used by the resident and garaged at the resident's home or a company car, leased or owned by a company with its principal place of business located outside of the Village, and used by a resident-employee and garaged within the Village) unless such motor vehicle is licensed by the Village or by the municipality from which any such vehicle is registered, for use for the current year and said license is displayed on the windshield of the motor vehicle. If an application for a state vehicle registration represents or a state vehicle registration database identifies that the vehicle has a situs within the corporate boundaries of the Village, that shall be deemed to be proof of these facts for the purposes of this Section.
   C.   Definitions: For the purposes of this chapter, the following terms shall have the following meanings:
   COMMERCIAL VEHICLE: Motor trucks, tractors, trailers and motor buses, whether or not actually used for commercial purposes, and all motor vehicles used for public hire.
   MOTOR BUSES: All vehicles used or designed for use for carriage of more than seven (7) persons.
   MOTOR TRUCKS: All motor vehicles, including tractor trucks, used or designed to be used to carry goods.
   MOTOR VEHICLE: Every self-propelled device in, upon or by which any person or property is or may be transported or drawn upon a street, except devices moved by human power or used exclusively on stationary rails or tracks.
   PERSON: Any individual, entity, firm, proprietorship, partnership, association, corporation or organization of any kind.
   PLEASURE VEHICLES: All motor vehicles used or designed to be used to carry not more than seven (7) passengers, and all recreational vehicles, excepting motor bicycles, tricycles and commercial vehicles.
   RESIDENT OF THE VILLAGE: A corporation or any business entity whatsoever having its principal place of business in the Village.
   SITUS OR BASE: When applied to a person, the place where that person or business is principally located and, when applied to a motor vehicle, the place where that motor vehicle is principally garaged, or from whence it is principally dispatched, or where its movements usually originate.
   TRAILER: Includes every vehicle without motor power designed to carry passengers or property and to be drawn by a motor vehicle.
   VEHICLE: Includes every device in, upon or by which any person or property is or may be drawn upon a street except devices moved by human power or used exclusively upon stationary rails or tracks.
   D.   Exemption:
      1.   A license shall not be required and imposed upon any person who satisfies the following criteria:
         a.   The person is a full time, active member of the United States armed services;
         b.   The person maintains his or her permanent residence (and domicile) in a municipality and/or state other than the Village;
         c.   But for his or her service in the United States armed services, the person would not reside in the Village;
         d.   The person uses his or her residence within the Village as a home base as a result of his or her present military assignment in the Chicagoland area, not a domicile; and
         e.   The person must provide proof of full time, active service in one of the United States armed services.
      2.   A person who is a member of any of the United States military reserves or the United States National Guard shall not be entitled to this exemption.
   E.   Eligibility If Debt Owed To Village: See the provisions of Section 3-1-1 A of this Code, which are incorporated by reference into this Chapter and are applicable to the licenses and permits covered by this Chapter. (Ord. 99-2073, 2-22-1999; amd. Ord. 19-2982, 11-25-2019)
