3-2-4: APPLICATIONS:
   A.   Applications for alcoholic liquor licenses shall be made to the local liquor control commission, which shall have authority to grant, suspend and/or revoke all such licenses. Applications shall be available from the village clerk or deputy village clerk during regular business hours. Such applications shall be made in writing, and shall be signed by the applicant, if an individual, or by a duly authorized agent thereof, if a club or corporation, verified by oath or affidavit, and shall contain the following information and statements:
      1.   The name, age and address of the applicant in the case of an individual; in the case of a copartnership, the persons entitled to share in the profits thereof; and in the case of a corporation for profit or a club, the date of incorporation, the object for which it was organized, the names and addresses of the officers and directors, and, if a majority in interest in the stock of such corporation is owned by one person or his nominee, the name and address of such person.
      2.   The citizenship of the applicant, his place of birth and, if a naturalized citizen, the time and place of his naturalization.
      3.   The citizenship of business of the applicant; and in case of a corporation the objects for which it was formed.
      4.   The length of time that the applicant has been in business of that character, or in the case of a corporation, the date on which its charter was issued.
      5.   The location and description of the premises or place of business which is to be operated under such license.
      6.   A statement whether the applicant has made similar application for a similar alcoholic liquor license on premises other than those described in this application and the disposition of such application.
      7.   A statement that the applicant has never been convicted of a felony and is not disqualified to receive a license, by reason of any matter or thing contained in this chapter, laws of this State or provisions of this Code.
      8.   Whether a previous license by any state or subdivision thereof, or by the Federal government has been revoked, and the reasons therefor.
      9.   A statement that the applicant will not violate any of the laws of the State of Illinois or of the United States, or any provision of this Code in the conduct of the place of business.
      10.   The name and address of the manager of the premises, if the premises are managed by a person other than the applicant.
      11.   In the case of a corporation whose manager of the licensed premises is not a resident of the Village, the name and address of a designated agent for the corporation who is a resident of the Village. (Ord. 89-04, 4-3-1989)
   B.   All applications for alcoholic liquor licenses shall be accompanied with the appropriate fee as designated herein.
      1.   The licensee shall faithfully observe and conform to all State laws and all provisions of this chapter and any and all hereafter passed during the period of said license, May 1 through April 30; and
      2.   In the event of a violation of any of the terms and conditions of this chapter and any amendments thereto, or State law, which results in the suspension and/or revocation of an alcoholic liquor license issued herein, the licensee shall pay any and all fines levied by the Local Liquor Control Commission and shall pay reasonable attorney fees to the Village Attorney for the prosecution of said violation.    C.   Applications for new and renewal alcoholic liquor licenses shall be considered in the same order in which they are received by the Village Manager; however, no such application shall be considered filed and received until accompanied by the appropriate fee and surety bond, as set forth in section 3-2-9 of this chapter and subsection B of this section.
   D.   Any licensee may renew his license at the expiration thereof, provided that he is then qualified to receive a license and the premises for which such renewal license is sought are suitable for the purposes, that he has met all of the application requirements herein, and provided further that the renewal privilege herein provided for shall not be construed as a vested right which shall in any case prevent the Village President and Board of Trustees from decreasing the number of licenses to be issued within the Village. This renewal privilege shall only apply to the license classification granted for the preceding license term. A renewal applicant who applies for a different license classification shall be considered a new applicant with respect to that different classification.
   E.   All applicants, both renewal and new, for alcoholic liquor licenses for the full term of May 1 through April 30 shall file their application and supporting materials between March 1 and April 1, both dates inclusive, immediately preceding the full license term. Any applications which are filed after April 1 will not be considered at the annual meeting of the Local Liquor Control Commission on the third Monday in April.
   F.   The Local Liquor Control Commission may require any applicant for a new or renewal alcoholic liquor license to be fingerprinted, pursuant to the Illinois Liquor Control Commission rules and regulations. (Ord. 89-04, 4-3-1989)
