In addition to the general requirements as stated herein this ordinance, the following land use design criteria shall apply to the areas designated on the area development plan on file in the city. The area development plan document which is made a part of this rezoning action delineates parcels of the specific plan as A and B (see exhibit A on file in the city). The following development standards and use regulations shall apply to each of the following development parcels:
A. Parcel A: The use regulations and provisions set forth in title 9 of the city code for regional commercial (RC) district shall apply to any development proposal for all property within this parcel as shown on the specific plan unless otherwise noted in this ordinance. This parcel shall contain no more than thirty six (36) acres.
1. Land Uses: Allowable land uses within this parcel are generally those set forth in title 9 of the city code for the regional commercial (RC) district. No commercial development for parcel A is proposed with this specific plan at this time. Any future development of parcel A will require an amendment of this specific plan ordinance. The specific allowed permitted (P) and permitted conditional (Pc) uses will be established at that time.
2. Setback, Open Space, Parking, Landscaping, Etc.: No commercial development for parcel A is proposed with this specific plan at this time. Any future development of parcel A will require an amendment of this specific plan ordinance. The specific requirements for commercial or office development on parcel A will be established at that time.
3. Parking For Parcel B: Some parking for the office development proposed on parcel B can be provided on parcel A, as shown on the specific plan map (see exhibit B on file in the city), subject to the parking and landscaping requirements of parcel B as stated in this ordinance. As a part of the development of parcel B, parcel A shall be landscaped to the minimum open space landscaping requirements of parcel B. The open areas may be planted with an aesthetically pleasing, low maintenance turf.
B. Parcel B: The use regulations and provisions set forth in title 9 of the city code for professional commerce park (PCP) district shall apply to any development proposal for all property within this parcel as shown on the specific plan unless otherwise noted in this ordinance. This parcel shall encompass approximately one hundred twelve (112) acres.
1. Land Uses: Allowable land uses within this parcel are all those set forth in title 9 of the city code for professional commerce park (PCP) district as permitted (P) or permitted conditionally (Pc) except for the following provisions:
a. The following nonoffice, commercial type uses listed as permitted or permitted conditionally within the professional commerce park (PCP) district shall not be allowed within this parcel, except as ancillary uses as provided in subsection B1b of this section:
Childcare services (SIC 835).
Funeral service, except crematories (SIC 726).
Hotels and motels (SIC 701).
News dealers and newsstands (SIC 5994).
Physical fitness facilities (SIC 7991).
Shoe repair (SIC 725).
Sit down restaurants (SIC 5812).
b. Certain internal commercial uses that are ancillary to an office park development and are intended to only serve the employees within this parcel, including a bank, company store, coffee shop, salon, dry cleaner, physical fitness facilities, cafeteria, and childcare services, shall be allowed. These uses shall not be advertised or available to the outside public. (Ord. 1589, 8-2-2004)
c. Certain external ancillary uses that are intended only to serve the employees within this parcel and shall not be advertised to the public or be available to the public except to the extent that they may be visible from the public right of way to include a noncommercial garden and one migratory bird nesting pole shall be allowed. The migratory bird nesting pole shall not exceed fifty five feet (55') in height, will be similar in color to other poles on site, will not be used to collocate any commercial or noncommercial antenna or light fixture, will not include signage or advertising, and will be removed if no migratory bird has nested on the pole during two (2) consecutive nesting seasons. The pole may be reinstalled in later seasons with the same stipulation that it be removed if not used as a nest during the following two (2) nesting seasons. The setback for the pole will be equal to the pole height from any property line. (Ord. 2071, 12-1-2014)
2. Setbacks: All building heights and setbacks shall be in accordance with the setback and bulk density regulations of the West Des Moines zoning ordinance for the professional commerce park (PCP) district unless otherwise herein modified.
3. Open Space: The minimum open space requirement for this parcel shall be thirty five percent (35%) of the total site area. The land area encompassed by the internal private roads, as shown on the area development plan (see exhibit A on file in the city), shall not be included in the total site area for the calculation of the open space requirement.
4. Landscaping: The minimum required landscaping within this parcel shall be based upon the amount of required open space. A minimum two (2) trees and three (3) shrubs shall be required for every three thousand (3,000) square feet of required open space with the following plant material size requirements:
a. Trees:
10 percent | 3 inch to 3.5 inch caliper |
30 percent | 2 inch to 2.5 inch caliper |
Balance | 1.5 inch caliper |
Minimum height for evergreens shall be 6 feet and may be counted as a 2 inch to 2.5 inch caliper tree |
b. Shrubs:
18 inches to 24 inches tall or 5 gallon size
5. Parking Lot Open Space: The open space requirement within the surface parking areas within this parcel shall be a minimum of ten percent (10%) of the parking lot area. This ten percent (10%) is not required to be in addition to the thirty five percent (35%) of open space required for the total site area of this parcel.
6. Parking Lot Landscaping And Screening: All parking areas shall be landscaped to screen their visibility from public rights of way or from any adjoining property outside the Wells Fargo West Des Moines Campus with the use of evergreen plant materials and/or berming and shall be reviewed at the time of review of the site plan for the development of the parcel. No parking space shall be farther than seventy five feet (75') from a bioswale, landscaped island, or landscaped open space area. Parking lot islands shall be a minimum eight feet (8') wide and landscaped with an organic ground cover or plant material - no rock or paving. Parking lot islands shall be installed on all parking lot end rows and located periodically throughout the parking lots to break up large expanses of paving and provide locations for landscaping and shade trees.
7. Parking Lot Setbacks: The parking lot setback shall be a minimum twenty feet (20') from any public street right of way. A zero foot (0') setback shall be permitted from any internal adjoining lots within this parcel provided those lots have interconnected parking lots. (Ord. 1589, 8-2-2004)
8. Parking Standards: The minimum parking space requirement for this parcel shall be 4.5 stalls per one thousand (1,000) square feet of building gross floor area. Parking stall and drive dimensions shall comply with city code. All parking lots and drives, including private roads, shall be constructed to city code including integrally attached PCC curbing a minimum four inches (4") tall. Curbing is not required adjacent to the parking lot bioswales. Instead, the bioswales will be edged with a six foot (6') wide sidewalk and a definitive border of boulders in order to permit the infiltration of parking lot surface water as desired. Angled parking located within parking structures (parking ramps) may have parking stall dimension of no less than eight feet nine inches (8'9") wide by seventeen feet one inch (17'1") deep with a minimum eighteen foot (18') wide one-way drive aisle.
