§ 91.05 NOISE FROM MOBILE SOURCES.
   (A)   No person shall create or cause to be emitted from any mobile noise source, other than his or her person, a noise which causes or results in a maximum noise level equal to or exceeding 85 dB(A) at a distance equal to or greater than 50 feet from the closest point of the source, except for trucks exceeding 10,000 pounds gross vehicle weight, for which the maximum allowable noise level shall be 90 dB(A) of a distance equal to or greater than 50 feet from the closest point of the source. For other measurement distances, the following table shall apply:

   (B)   For trucks exceeding 10,000 pounds gross vehicle weight, the permissible noise levels in the preceding table shall be increased by five dB(A).
   (C)   Whoever violates this section is guilty of a minor misdemeanor for a first offense. For a second or subsequent offense, such person is guilty of a misdemeanor of the fourth degree. The penalty shall be as provided in § 130.99 of this code of ordinances.
