§ 90.21 KEEPING OF FOWL IN A RESIDENTIAL AREA.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      FOWL. Includes geese, turkeys, ducks, chickens and pheasants.
      RESIDENTIAL AREA. Any location within the village’s municipal boundary that is on land or abuts land containing residential dwellings of any kind.
   (B)   A person who keeps fowl on any land in a residential area of the village shall comply with all of the following requirements:
      (1)   Keep no more than a total of five fowl, of every kind, nature and description;
      (2)   The principal use of the land on which fowl are kept shall be residential;
      (3)   No person shall keep any rooster;
      (4)   The fowl shall be provided with a covered enclosure and must be kept within the covered enclosure or a fenced enclosure at all times;
      (5)   A person shall not keep fowl in any location on land other than in the backyard. For purposes of this section, BACKYARD means that portion of land enclosed by the property’s rear property line and the side property lines to the points where the side property lines intersect with an imaginary line established by the rear of a residential dwelling of any kind and extending to the side property lines;
      (6)   All enclosures for the keeping of fowl shall be so constructed or repaired as to prevent rats, mice or other rodents from being harbored underneath, within, or within the walls of the enclosure; and
      (7)   All feed and other items associated with the keeping of fowl that are likely to attract or to become infested with or infected by rats, mice or other rodents shall be protected so as to prevent rats, mice or other rodents from gaining access to or coming into contact with them.
   (C)   Whoever violates any of the provisions of this section is guilty of a minor misdemeanor.
