§ 93.01 PERMIT REQUIRED; FEE; DEPOSIT.
   (A)   No person, other than the Village Administrator, the Village Engineer or the authorized employees or agents of either, shall make any excavation in any street, alley, sidewalk or other public way of the village unless a permit to make such excavation has been obtained prior to the commencement of the work, as hereafter provided.
   (B)   Each permit for such excavation shall be confined to a single project and shall be issued by the Mayor, the Village Administrator or other duly appointed official. The fee for such permit shall be $75. Application shall be made on a form prescribed by Council, giving the exact location of the proposed excavation, the kind of paving, the area and depth to be excavated and such other facts as may be provided for. The permit shall be issued only after the person applying for such permit makes a cash deposit of $150 plus $1 per square foot of excavation surface exceeding 25 square feet, conditioned upon prompt and satisfactory refilling of the excavation and restoration of all surfaces disturbed. If the excavation is promptly and satisfactorily refilled and all surfaces disturbed are restored, $150 shall be returned to the permittee.
