Variances shall not be granted on the grounds of convenience or profit, but only where strict application of the provisions of these zoning regulations would result in unnecessary hardship. The burden of proof for granting a variance shall rest with the applicant. In granting any appeal or variance, the Village Planning Commission may prescribe such conditions and restrictions as may be necessary to comply with the standards in this section and the intent purpose of these zoning regulations. Violation of such conditions and restrictions, when made part of the terms under which the appeal or variance is granted, shall be deemed a violation of these zoning regulations and punishable under § 154.999 of these zoning regulations. Under no circumstances shall the Village Planning Commission grant an appeal or variance to allow a use prohibited expressly or by implication in the zoning district in which the property in question is located.
