§ 154.098 APPROVAL OF CONDITIONAL USES.
   The burden of proof for granting a conditional use permit shall rest with the applicant. In granting any conditional use permit, the Village Planning Commission may prescribe such conditions and restrictions as may be necessary to comply with the standards in this chapter and the intent and purpose of these zoning regulations. Violation of such conditions and restrictions, when made part of the terms under which the conditional use is granted, shall be deemed a violation of these zoning regulations and punishable under § 154.999 of these zoning regulations. Under no circumstances shall the Village Planning Commission authorize a conditional use to allow a use prohibited expressly or by implication within the zoning district in which the property in question is located.
