Any business owner/operator that violates any section of this chapter or fails to renew or update the license as required herein within twenty (20) days of the due date for renewal or update, upon being found guilty to, shall be guilty of an infraction and will be required to pay a fine in the amount of one hundred dollars ($100.00) plus any costs associated and levied by the Courts for infraction offenses.
(A) Any person who violates, disobeys, neglects. omits. tries willfully to circumvent the intent of the chapter, refuses to comply with this chapter, or resists enforcement of any of its provisions more than (15) days after having received a warning of such violation shall be subject to a Wendell City Ordinance violation fine in the amount of one hundred dollars ($100.00). Failure to cure an issued Code and Ordinance violation citation within a time period of ten (10) days will result in additional fines and/or penalties as provided herein.
(B) Additional Remedies: Instead of, or in addition to, the penalties or relief provided above, the City of Wendell may take such other available legal action as is necessary to prevent or remedy any violation of this ordinance. A civil action may be commenced and pursued in the Gooding County Court for the purpose of enforcing or correcting any violation of this ordinance, including, but not limited to, an order enjoining or preventing operation of the business in violation of this chapter.
