8-2-14: LIABILITY:
Any person subject to regulation under this chapter shall be liable with respect to regulated substances emanating on or from the person's property for all cost of removal or remedial action incurred by the city and/or Bear River health department, and for damages for injury to, destruction of, or loss of, natural resources, including the reasonable cost of assessing such injury, destruction, or loss from the release or threatened release of a "regulated substance", as defined by section 8-2-4 of this chapter. Such removal or remedial action by the city and/or Bear River health department may include, but is not limited to, the prevention of further contamination of ground water, monitoring, containment and clean up, or disposal of regulated substances resulting from spilling, leaking, pumping, pouring, emitting or dumping of any regulated substance or material which creates, or is expected to create, an emergency hazardous situation.
