7-5-2: SHADE TREE AND BEAUTIFICATION COMMISSION 1 :
   A.   Established; Compensation: There is created and established a shade tree and beautification commission for the city, which shall consist of eleven (11) members, citizens and residents of the city. Ten (10) of said members shall be appointed by the mayor with the approval of the city council. The eleventh member shall be the city council member responsible for activities of the shade tree and beautification commission (commission) and shall be an ex officio member. All members of the commission shall serve without pay. (1991 Code § 12.16.020, as amended)
   B.   Term Of Office: The term of the ten (10) members to be appointed by the mayor shall be three (3) years, except that the term of two (2) members appointed to the first commission shall be for only one year and the term of two (2) members appointed to the first commission shall be for two (2) years. The term of the council member shall run with the term of the council member's office. Appointments to office will be made on or before the first Monday in February of each year. In the event that a vacancy shall occur during the term of any member, his or her successor shall be appointed for the unexpired portion of that term.    C.   Duties And Responsibilities: The duties and responsibilities of the commission are as follows:
      1.   To study the problems and determine the needs of the city, in connection with its community forest;
      2.   To adopt and then periodically review and update a city community forest plan, which designates the type and kind of trees to be planted upon city streets and in parks;
      3.   To collect and allocate funds from public and private sources for the planning and management of the community forest and the beautification of the city;
      4.   To assist in the dissemination of news and information regarding the selection, planting and maintenance of trees within the corporate limits, whether they be on public or private property, and to make such recommendations from time to time to the city council as to desirable legislation concerning the community forest program and activities for the city; and
      5.   To consider, investigate, make findings, report and recommend upon any special matter or question within the scope of its work when requested by the city council. (1991 Code § 12.16.040, as amended)
   D.   Operation: The commission shall choose its own officers, make its own rules and regulations, subject to approval of the city council, and keep a journal of its proceedings. A majority of the members shall be a quorum for the transaction of business. (1991 Code § 12.16.050, as amended; amd. 2009 Code)
   E.   Review; Appeal: The city council shall have the right to review the conduct, acts and decisions of the shade tree and beautification commission. Any person may appeal any ruling or order of the commission to the city council, who may hear the matter and make a final decision. (1991 Code § 12.16.150, as amended)
