1-5-3: MAYOR:
   A.   Powers And Duties:
      1.   Except as provided in subsection A2 of this section, the mayor:
         a.   Is the chief executive officer of the city to whom all employees of the city report;
         b.   Shall:
            (1)   Keep the peace and enforce the laws of the city;
            (2)   Ensure that all applicable statutes and city ordinances and resolutions are faithfully executed and observed;
            (3)   If the mayor remits a fine or forfeiture under subsection A1c(2) of this section, report the remittance to the city council at the council's next meeting after the remittance;
            (4)   Perform all duties prescribed by statute or city ordinance or resolution;
            (5)   Report to the city council the condition and needs of the city; and
            (6)   Report to the city council any release granted under subsection A1c(4) of this section;
         c.   May:
            (1)   Recommend for city council consideration any measure that the mayor considers to be in the best interests of the city;
            (2)   Remit fines and forfeitures;
            (3)   If necessary, call on residents of the city over the age of twenty one (21) years to assist in enforcing the laws of the state and ordinances of the city;
            (4)   Release a person imprisoned for a violation of a city ordinance;
            (5)   With the city council's advice and consent:
               (A) Assign or appoint a member of the city council to administer one or more departments of the city; and
               (B) Appoint a person to fill:
                  (i) A city office; or
                  (ii) A vacancy on a commission or committee of the city; and
            (6)   At any reasonable time, examine and inspect the official books, papers, records or documents of:
               (A) The city; or
               (B) Any officer, employee or agency of the city.
      2.   The powers and duties in subsection A1 of this section are subject to:
         a.   City ordinances in effect on May 4, 2008, modifying the powers and duties of the mayor; and
         b.   The city council's authority to limit or expand the mayor's powers and duties under Utah Code Annotated section 10-3b-303(2)(a).
   B.   Voting; Authority: The mayor:
      1.   Is, except as provided in subsection B2 of this section, a nonvoting member of the city council;
      2.   Votes as a voting member of the council:
         a.   On each matter for which there is a tie vote of the other council members present at a council meeting; or
         b.   When the city council is voting on:
            (1)   Whether to appoint or dismiss a city manager; or
            (2)   An ordinance that enlarges or restricts the mayor's powers, duties or functions;
      3.   Is the chair of the city council and presides at all council meetings;
      4.   Exercises ceremonial functions for the city;
      5.   May not veto an ordinance, tax levy or appropriation passed by the city council;
      6.   Except as modified by ordinance under Utah Code Annotated section 10-3b-303(2), has the powers and duties described in subsection A of this section; and
      7.   May, within budget constraints, appoint one or more administrative assistants to the mayor.
   C.   Mayor Pro Tempore:
      1.   If the mayor is absent or unable or refuses to act, the city council may elect a member of the council as mayor pro tempore, to:
         a.   Preside at a city council meeting; and
         b.   Perform, during the mayor's absence, disability or refusal to act, the duties and functions of mayor.
      2.   The city recorder shall enter in the minutes of the city council meeting the election of a council member as mayor pro tempore under subsection C1 of this section. (2009 Code)
